This agreement establishes the terms of your pole pole savings with The KENYA Airlift Program (“Company” or “The KAP”). Please read it carefully.
In establishing a Pole Pole Savings Account(s) (“Account”), you have indicated your agreement to and acceptance of this document, The KAP Online Savings Account Agreement (the "Agreement" or “Terms and Conditions”); and receipt of The KAP Privacy Policy.
This Agreement is a contract between you and The KAP that sets forth the terms and conditions under which Online Savings Accounts are made available to you. By indicating your acceptance of this Agreement and The KAP Privacy Policy, and by establishing, using or continuing to have an Account, you agree to be bound by the terms and conditions contained in this Agreement, including the Arbitration and Funds Availability Schedule provisions, as may be amended.
"Account" or “Savings Account” mean the Online Savings account product you have opened with The KAP for the purposes of relocating to United States as an international student.
"Agreement" or “Terms and Conditions” mean this document and any changes we make to this document, from time to time.
“Deposit Account” shall mean an Online Savings account you may have with us "Privacy Policy" shall mean The KAP Privacy Policy, which governs the customer information-related operations.
"You" and "your" shall mean the person or persons in whose name an Account is titled.
"We," "us," "our," "The KAP," shall mean The KAP, our successors, affiliates, assignees and service providers.
We will use the most recent contact information you have provided to us to communicate with you. You are responsible for notifying us of any change in your name, address, or other contact information (including telephone number and email address).
The KENYA Airlift ProgramAs noted above, we will communicate with you using the most recent contact information you have provided to us.
To ensure that we have the most accurate and up-to-date customer information, from time-to-time we will ask you to verify your account details such as your date of birth and address. Access to your account may be restricted until you verify this information.
By submitting an application to open your pole pole account, you authorize us to obtain information about you from time to time from consumer reporting agencies, from our subsidiaries and affiliates, and other third parties for the purpose of considering your account application or any other legitimate purpose.
Accounts are not negotiable and not transferable.
If we receive any conflicting claims to funds in your Account and we cannot determine the rights of the claimant to any such funds, or if we know of or believe that there is a dispute over the ownership or control of funds in your Account, we may, in our sole discretion: (a) place a hold on your Account; (b) refuse to pay out any funds in the Account until we are satisfied that the dispute is settled.
By opening your pole pole savings Account with us, you agree that we have the right to set off with respect to your Account(s). If you owe us or any of our affiliates money and that money is due, you agree that we may withhold or withdraw from your Account any amounts you owe to us or any of our affiliates unless prohibited by applicable law. We may exercise our rights of set-off without recourse to other collateral, if any.
You may choose to make deposits into your Account at any time.
You are required to maintain a minimum of $100 (which is non-refundable Sacco registration fees)
You can withdraw from the program at any time and the $100 plus the registration fee of $10 will not be refunded to you. You cannot withdraw funds from your pole pole savings account unless you entirely withdraw from the program.
There will be no interest earned on your pole pole savings. The savings program is entirely for your relocation expenses in the program.
Your savings contribution will be in USD and incase of withdrawal from the program, the money refunded with be dollar equivalent of Kenya shillings.
